Jury Awards $4.5 Million To Three Families
A Jackson County jury has awarded $4.5 million in actual damages to three families that claimed the stench from a local hog farm was causing a nuisance. The families had also filed for punitive damages but decided to drop this providing the pork production company agreed to pay the damages that were agreed upon.A lawyer for the three families stated: ‘Hogs were the first nuisance cases under English law in the 1600s, and it’s kind of ironic that they’re coming back.’ The lawsuit was filed against the owners of the hog farm, which was Premium Standard Farms Inc.
Although the jury also stated that the plaintiffs were entitled to punitive damages, the company decided to settle before the second part of the trial because the plaintiffs said that they would then drop the case for punitive damages.
Premium Standard Farms Inc. is the second largest pork producer in the United States, employing over 2,000 people. The plaintiffs’ lawyer described the award as “by far and away the biggest award against a major confined animal producer.”
