Lawsuit Filed Over Incarcerated Woman
The Southern Center for Human Rights has filed a lawsuit after it was revealed that a woman has been incarcerated for more than eight months more than she should have been, simply because she cannot afford to pay a fine of just over seven hundred dollars.Ora Lee Hurley was actually sentenced to 120 days at the Gateway Diversion Center in Atlanta. She does have a job, for which she receives day release for five days a week, but the pay is not enough to enable her to pay the fines and costs associated with getting released from the center.
"This is another debtor's prison case," said Sarah Geraghty, a lawyer for the Southern Center for Human Rights. "This is a situation where if this woman was able to write a check for the amount of the fine, she would be out of there. And because she can't, she's still in custody. It's as simple as that."
The lawsuit further stated: "Despite diligently working at a restaurant for nearly a year, turning her check over to the Georgia Department of Corrections and fulfilling all of the other requirements imposed by the diversion center, Ms. Hurley is still in custody."
