$40 Million Payout To Family Of Brain Damaged Baby
The family of a baby who sustained brain damage during birth in 1996 have been awarded nearly $40 million. The award is being hailed the biggest in state history. The Middlesex County jury deliberated for over six hours before coming back with the verdict, finding the obstetrician involved in the delivery guilty of negligence.Philip Antonelli Jr. suffered the brain damage after a traumatic delivery at a Lowell hospital. It is alleged that the obstetrician waited for hours before delivery, even though the unborn baby was showing signs of severe distress. Philip, now aged eight years, suffers from cerebral palsy, and has the mental and physical capacity of a 2 to 4 year old.
The boy’s mother stated she felt relieved by the outcome of the case. She stated: "We feel pretty much validated. All this time, we thought that things had been wrong with the quality of care that we received. And now we know that's the case."
The prosecuting lawyer stated that the fetus had started to show signs of severe fetal distress early on, and the obstetrician then ordered a caesarean section. However, because the obstetrician still did not deem this an emergency, it was left for another few hours.
