Legal Action Of Medicare Lawsuits
A lawsuit has been filed after refunds were mistakenly sent out to over 200 Medicare beneficiaries last month. The refunds occurred as the result of a computer error, and were for an average of over $200 each. However, the government is now trying to reclaim the monies that were mistakenly sent out to the beneficiaries.The Center for Medicare Advocacy Inc. has stated that because the recipients of the refund were not at fault, many of the beneficiaries are entitled to a waiver of recovery under federal law, entitling them to keep the refund that they have received.
The Centers for Medicare and Medicaid services have since agreed to stop drafting and sending out letter demanding back the refund, and have also agreed to remove any details on their websites relating to the return of the refunds.
A spokesperson for the Center of Medicare Advocacy stated: "The next steps are for CMS to return monies already repaid and inform all beneficiaries who received the incorrect refunds of their right, under federal law and the U.S. Constitution, to seek waiver of recovery."
