Court Asked To Reinstate Abuse Lawsuit
A court has been asked to reinstate a lawsuit relating to abuse at an Indian boarding school located in South Dakota. The South Dakota Supreme Court has been approached and asked to reinstate the lawsuit, which alleges that a number of former students were abused at St. Paul’s school, located in Marty.The original lawsuit was dismissed earlier on this year by Circuit Judge Bradley Zell of Sioux Falls. The judge stated at that time that the former students had left it too long before deciding to sue the Catholic Diocese of Sioux Falls, as well as the other organizations that ran the school at the time of the alleged incidences of abuse.
The lawsuit that was filed made a number of allegations, and this included accusations that the school was negligent when it came to the hiring, firing, and supervising of staff, as well as negligence in the protection of students at the school, who are said to have been the victims of abuse.
However, the judge that dismissed the lawsuit stated that the students had failed to provide evidence in a number of areas, including evidence that they only discovered their injuries within the three years prior to the filing of the lawsuits, and evidence that the organizations running the school were aware of the abuse but did nothing about it.
