Former College Instructor Settles Lawsuit
A former college instructor has settled a lawsuit after accusing the college where he worked of violating his civil right and of breach of contract. Alberto Benitez, the former instructor, filed the lawsuit against Del Mar College, and according to a lawyer working on behalf of Benitez an agreement was reached between the college and the plaintiff late last week.A federal trial was due to begin in relation to the case this week, with the agreement being reached just days before the trial was set to start. No terms were disclosed by attorneys in relation to details of the settlement. The plaintiff’s attorney simply stated: "I can say that both parties have reached an agreement without having to go to trial."
The lawsuit was filed by Benitez in 2005, after he claimed that he was unfairly fired from his job at the college by officials simply because he supported the claims of racial harassment made by a student against another college employee. The student, Melody Lopez, was also involved in filing the lawsuit.
Although a settlement has been agreed with Benitez, nothing has been agreed in relation to Ms Lopez’s lawsuit, and therefore this part of the case is still expected to go to trial.
