Study Finds A Dramatic Fall In Tort Trials
A government study recently conducted has found that the number of tort cases in federal court has dropped by around 80% in fewer than 20 years. This fall in tort trials has been partly attributed to Supreme Court rulings in the 1990s, which legal experts think helped to bring the figures down.The majority of the tort trials in federal court involve personal injuries, and the average compensation won by successful plaintiffs in 2003 was around $200,000 according to statistics. However, in February President Bush signed legislation that will see large class action suits disappear from federal court. The president sees this as a step to end the lawsuit culture.
Nan Aron, president of the Alliance for Justice, opposes the legislation, and stated that the study results were "ominous - victims of corporate misconduct or negligence may have great difficulty obtaining redress in the federal courts."
The figures from the recent study indicated that in 1985 there were 3,600 tort trials that were seen through the federal courts. However, by 2003, this figure had dropped to just eight hundred.
