Doctor Sues Boston Scientific Corp
A doctor from Florida is suing the Boston Scientific Corp for infringing his patents after the corporation developed an artery repair device. The doctor, who is also an inventor, alleges that the device infringes his patents, and that it is based upon an idea that was taken from him by another doctor.Dr. Shaun Samuels claims that he confided in another doctor about his idea in 1997, but that the other doctor broke his confidentiality and leaked the details of the idea to a new company after signing an adviser. The new company then developed the products and Boston Scientific invested in the company and the product.
The lawsuit claims that the corporation has enough information and detail to know that the information to develop the device was obtained improperly. He asked the courts to prevent the sales of the device, and to award him tripe damages for the infringement issues.
A spokesman for the corporation stated that the doctor’s lawsuit had not merit. "Dr. Samuels has raised these allegations before, in a lawsuit which he filed and subsequently withdrew. We have had an opportunity to look into his claims and we believe they are groundless. We will defend this lawsuit vigorously."
