The history professor, Richard Lewis, sued the University Chronicle over the article, which was published in 2003. The article included claims from a former student of the university that accused Lewis of anti-Semitism and racism. A retraction was published in the paper when it was discovered that the reporter on the article has misunderstood, but Lewis was not satisfied with the retraction.
However, when dismissing the lawsuit that was filed by Lewis last week the judge stated that the newspaper was not legally obliged to refrain from printing the allegations, and that it was up to Lewis to prove that the newspaper printed the allegations recklessly or with malicious intent.
Lewis had also stated in his suit that he should have been contacted for comments before the article was published, but newspaper staff stated that in the past he had always made himself unavailable for comment. The judge stated: "The law should not reward the defamation Plaintiff who chooses to be unavailable for comment."
