Courts Reverse Class Action Status Is Case
For the second time around, class action status in a case against Anthem Health Plans Inc. has been reversed by the Connecticut Supreme Court. The lawsuit accuses the company of unfair reimbursement practices.The Supreme Court found that the trial court failed to apply correct standards and failed to look at the difficulties that would arise if the case were to be treated as a class action.
The plaintiffs in the case are orthopaedic surgeons that were providing health care and treatment to members of the company’s plans, and these doctors claim that the company has breached its contract with regards to its reimbursement practices.
The first time class action status was reversed on the case was in 2003, and it was reversed because the judge had allegedly failed to undertake the necessary inquiries. It was found at that time that Judge Sheedy, who was dealing with the case, did not make the necessary inquiries with regards to establishing the facts.
