Woman That Gave Birth Through Donated Eggs Is The Legal Mother
A Tennessee court has ruled that a mother that gave birth to triplets through donated eggs will be deemed the legal mother of the children. The Tennessee Supreme Court made this ruling late last week, deciding that although the woman does not have a genetic link to the babies she will still legally be the mother of the three. Lower courts had already granted these parental rights to the birth mother and the Supreme Court upheld the decision.The woman had used anonymous donated eggs when she and her partner decided that they wanted to have children. Cindy Culpepper and Charles Galiwango were not married at the time, and the donated eggs were fertilized by Charles. However, one of the eggs divided when implanted, and this resulted in triplets. The children were born in 2001. The couple’s relationship deteriorated and Mr. Galiwango decided to challenge his ex-partner’s parental rights.
However, the courts decided that since Culpepper was meant to be the legal mother before the relationship ended she would remain so even after it had ended. One official stated: "Recent developments in reproductive technology have caused a tectonic shift in the realities which underlie our legal conceptions of parenthood."
One law professor stated: "In most states, the courts have not looked beyond the biological connections, marriage or adoption in determining the definition of a parent. People who support greater rights for nontraditional parents like gay couples would be encouraged by an opinion that would define parent more broadly than simply by marriage, genetics or adoption."
