Judge Dismisses Lawsuit Against Alcohol Firms
A Colorado judge has dismissed a lawsuit in which a variety of alcohol companies were accused of targeting underage people with advertisements for their alcoholic beverages. The class action suit was being dealt with by Jefferson County District Court Judge James D. Zimmerman.The judge decided to dismiss the class action suit because there was no evidence of any minors suffering damage of any kind as a result of the advertising, and he also awarded attorney fees and costs to the defendants.
The judge stated: "The court concludes that there is a legally protected and cognizable interest for parents that recognizes parents' right to sue for their own economic harm for actions aimed at their children, but only when the child has sustained physical injury. . . . It clearly appears that the plaintiffs cannot prove facts in support of their claims that would give them standing to obtain the relief they seek in court."
The suit was filed by Randy and Colleen Kreft in 2003, and the couple claimed that the companies named as defendants used a variety of schemes in order to target minors.
