Judge Strikes Testimony Of Merck Defense Witness
In the second Vioxx trial to hit the courts, Merck have been hit with another setback, as the judge struck the testimony of the first defense witness. The testimony came from a Merck researcher, claiming that studies in the 1990s showed that the pain reliever would not cause heart problems. The testimony came from Dr. Briggs Morrison, who was Merck’s first defense witness in the trial of postal worker Frederick Humeston, who suffered a heart attack in 2001, which he claims was a result of taking Vioxx.After reading the transcript from the doctor, Superior Court Judge Carol Higbee stated that she felt sickened, and that the doctor was not an expert in the areas about which he testified, not did Merck give enough notice with regards to what the defense witness would be discussing. The judge stated: "I felt sick last night, and I realized how I got sucked into this. I feel that the court was misled repeatedly with this testimony."
In his testimony the Merck researcher stated that test carried out on animals and elderly people in the 1990s had shown that Vioxx posed no risk of heart attacks, but the judge and the prosecution lawyers argued that this information had not been mentioned in the deposition. The judge also stated that the testimony now given by Morrison was very different to the information he had provided in the earlier deposition.
In his defense, Morrison stated that he had only found out about these studies whilst preparing for the trial, hence the difference in information from the deposition and testimony.
