Heirs Of Writer Sue Heirs Of Compose
The heirs of a writer that penned the words for a number of operas are suing the heirs of a compose who wrote the music for the operas, claiming that before his death the composer had provided contracts that gave the writer – and therefore his heirs – a cut of the royalties from his music in exchange for the rights to use the words penned by the writer.The heirs of the German composer Richard Strauss are being sued for a chare of the royalties on nine works, including “Der Rosenkavalier” and “Elektra”. The plaintiffs are the heirs of the writer Hugo von Hofmannsthal. They say that Strauss promised Hofmannsthal a cut of the royalties from his music in exchange for rights to use his words, and the promise was extended to the heirs after Hofmannsthal died.
The sum of the royalties due to the heirs of Hoffmansthal could amount to around one million dollars each year if they are successful with the case, which is currently being considered by a judge.
Although the plaintiffs have provided evidence of contracts that verify the deal, there is no detail regarding the length of time for which royalties should be received by the Hofmannsthals. Further contractual evidence has been requested by the courts prior to a ruling being made.
