Lawyers Could Lose Licenses Over Frivolous Lawsuits
Republicans are debating a bill that could result in lawyers losing their licences for a year if they are found to be filing frivolous lawsuits that could be construed as an abuse of the legal system in the United States.The bill is part of a crack down by republicans to cut down on repeated filing of frivolous and costly lawsuits by legal professionals. Supporters of the bill have deemed such cases a waste of court time and simply a way for the lawyers filing the suits to improve their own reputations rather than a fight for justice.
Rep. Lamar Smith, R-Texas, the bill's sponsor stated that both insurance premiums and health care costs have risen as a result of such lawsuits. He stated: "All they want is for the defendant to settle. This is legalized extortion." However, the opposition for the bill argues that these lawsuits have no effect upon the cost of insurances and health care costs, and also argue that the bill could have a negative effect on a variety of legitimate lawsuits being filed.
It is currently up to judges to determine whether to enforce penalties, as the bill was passed last year but never came up for a vote in the Senate. If the bill gets passed lawyers seen as filing frivolous claims without merit could lose their licenses for a year or more.
