United Airlines Attendants’ Appeal Rejected
An appeal made by flight attendants of United Airlines has been rejected by the courts. The appeal related to the approval previously given to the airline to terminate its pension plan. The three judge panel at the federal court stated that there was no reason to reverse the approval, which was previously granted by a bankruptcy judge, where the airline will be able to transfer the plans to the government’s pension insurer, the Pension Benefit Guaranty Corp.However, an argument has been put forward by the Association of Flight Attendants that the termination of plans violated its labor contract. The union includes over nineteen thousand United flight attendants, and plans to fight the PGBC in the Washington courts.
One spokesperson stated: "Everyone knows termination of the Flight Attendant Pension Plan is wrong. The PBGC must be held to answer for its actions." Another spokesperson added that a replacement should have been negotiated for employees, as has been done through other airline unions.
The original ruling was made in May in the bankruptcy court, and the ability to transfer the pension plans could save the airline around $645 million each year.
