Bumped Passenger Gets Payout
A passenger that was bumped off an overbooked flight with Continental Airlines has been awarded over three thousand dollars by a Manhattan judge for his inconvenience and expenses. The Aviation Lawyer, Thatcher Stone, was travelling with his daughter from Newark Airport on Christmas Day 2004 and was kept off the flight because the airline had overbooked.The lawyer and his thirteen year old daughter were traveling to go on a skiing holiday, which they had booked between Christmas and New Year. However, upon arrival at the airport they were told there were no seats and were unable to travel. In addition, the lawyer stated, their baggage was loaded on to the aircraft and staff refused to take it back off again even though they were not allowed to travel. "We asked the gate agent to call downstairs and tell them to off-load our bags, but he wouldn't. All our winter clothes were in the luggage."
As an alternative, the airline offered them a flight departing the day before they were due to actually come back from their vacation. The cost of the tickets was refunded but they were unable to make plans due to their winter clothes still being on board the plane. He had to pick the baggage up from the airport three days later.
The award was made after Mr. Stone sued for financial losses and inconvenience.
