Convictions Stand Despite Incomplete Transcripts
A judge has decided that convictions for ten people will stand despite the fact that the transcripts were incomplete. The reason for the incomplete transcripts was that the court reporter suffered interference with her work through breast cancer. The convictions were made in a three year period between 1999 and 2002. However, defendants’ lawyers had appealed over a variety of issues.Because of the incomplete transcripts, or in some cases the missing transcripts, the Colorado Court of Appeals switched the cases to a lower court. A judge has stated that there is no guarantee of a speedy appeal. The judge, Colorado Supreme Court Chief Justice Anthony Vollack. Stated that defendants do have the right to a speedy trial but that appeals do not offer the same rights or guarantees.
The District Attorney has confirmed that the transcripts are being dealt with slowly since the court reporter quit, and that because her writing is difficult to decipher other court reporters are finding it difficult to progress with the transcripts.
The court reporter who should have completed them, Valerie Barnes was found in contempt for her refusal to help in completing the transcripts. However, she has filed an appeal against this charge.
