Despite the numerous accidents and injuries that have been reported, there has never been a Yamaha Rhino recall of the Yamaha Rhino 660 ATVs or Rhino ATVs manufactured before 2008. Instead, the company has issued warning letters advising Yamaha Rhino owners of the vehicle’s potential for dangerous rollover accidents. In addition, owners of these vehicles have been offered upgrade kits that add doors, handholds, and warning labels to the Yamaha Rhino base models.
There have been Yamaha Rhino recalls for about 7,800 2008 Yamaha Rhino YXR450 and YXR700 vehicles. The recall for these vehicles was related to a faulty brake design where improperly-manufactured brake calipers on the left front wheel caused a brake fluid leak. Brake fluid leaks pose a serious health and safety risk to drivers and passengers, because the loss of brake fluid pressure can cause a brake failure making it impossible to stop the vehicle.
For the Yamaha Rhino 660 ATV and the pre-2008 Rhino ATVs, there has been no Yamaha Rhino recall. However, the company sent out a warning letter that advised riders:
If you are in a situation where the vehicle is tipping over, do not put your arm or leg outside the vehicle to try to stop it. You could be severely injured. You could suffer a crushed hand, arm, leg, or foot, if part of your body is caught underneath the vehicle. You must keep your arms and legs inside the vehicle until it has stopped moving.
To help remind you and other operators or passengers in your Rhino of this important information, Yamaha has prepared new warning labels, one for each side of the enclosure. We recommend you install these labels on your Rhino or have your authorized Yamaha dealer install them for you.
In addition, Yamaha has developed new doors and passenger handholds for the Rhino vehicles, rather than issue a full Yamaha Rhino recall. These doors and handholds can be installed on Rhino vehicles to increase the safety of the vehicles, particularly in the area of encouraging passengers to use the handholds rather than sticking arms or legs outside of the vehicle in an accident scenario.
These safety modifications address some of the design flaws of the Yamaha Rhino models, but do not amount to a Yamaha Rhino recall. It is not necessary for Yamaha to recall the vehicle for injured persons to have a cause of action, however. All injury and wrongful death liabilities are tried as individual cases, which means that the specific facts of your rollover or accident are taken into account, even without a Yamaha Rhino recall. An expert attorney who is well-versed in personal injury and wrongful death litigation will be a valued assistant in your quest for just compensation for injuries or deaths suffered in an accident involving a Yamaha Rhino.
