In the State of Idaho, workers' compensation activities are regulated by the Idaho Industrial Commission. It has the responsibility to license those private insurance companies approved to issue policies to employers for workers compensation benefits. It is the agency responsibility for mediating and resolving disputes between insurers and the injured employees. It enforces the requirement that employers have the required workers compensation coverage and provides rehabilitation services to job site injured Idaho workers at no cost. The Commission has other responsibilities as well that are only indirectly related to workers compensation.
The mission of the Industrial Commission is to administer the Idaho Workers' Compensation Law in a way that provides quality a vocational rehabilitation program, fair dispute resolution and judicial review, timely and accurate benefit checks, and compliance with requirements of the insurers.
Four divisions come under the general structure of the Idaho Industrial Commission. Three of the four are involved with workers compensation activities: the Compensation Division, the Rehabilitation Division and the Adjudication Division.
Compensation Division
The Compensation Division is responsible for employer compliance, benefits administration human resources, information technology, fiscal and administration. Employer Compliance section labors to make certain that Idaho employers are in compliance with their obligation under the Idaho Code to provide adequate workers compensation benefits for eligible workers. This includes both medical and indemnity coverage for employees not previously protected.
Because Idaho has a rapidly growing economy and many new workers in the new businesses created, compliance has been strongly impacted. New employers are entering Idaho in significant numbers and must be brought up to speed on Idaho's requirements for coverage quickly. The new businesses sometimes create competition economically with existing businesses who may attempt to cut costs in ways that put the businesses out of compliance in the area of worker protection.
Benefits Administration is the section of Compensation that ensures employees are paid authorized benefits in an accurate and timely manner. Although the number of employees covered in Idaho's workforce has increased more than 50,000 employees in 2006, it did not lead to an increase in the claims rate per 100 employees. At 6.19 claims per 100, this reflects a drop of 15% over the last five years. Benefits Administration is also responsible for the prompt payment of medical expenses to service providers and conducts extensive programs for reaching out to all stakeholders in the compensation system.
Rehabilitation Services
The mission of the Rehabilitation Services Section of the Idaho Industrial Commission is to maintain the fiscal health of Idaho by promptly rehabilitating workers who have been injured to full and productive employment. The specialists in this agency help by determining the needed requirements of the existing job at time of injury and designing necessary modifications to allow the tasks to be completed satisfactorily even if there is a physical disability. Every effort is made to work with the employer at the time of the injury to find acceptable work opportunities. Failing that, the specialists assist the injured worker to find other suitable employment opportunities. This service is provided free of charge to the worker, employer or insurer.
Adjudication Division
This Division of the Idaho Industrial Commission has the responsibility of providing judgments in disputes between employers and workers regarding workers compensation. Although the workers compensation system historically is the sole remedy for those workers who sustain on the job injuries it also serves as protection for employers against civil action due to on the job mishaps. Typically the three judge panel that makes up the Commission will not have to be involved in disputes because potential conflicts are settled through mediation or informal hearings.
