Any job-based savings program, stock options, IRA’s, or 401k plans may also be transferred in the same manner (depending upon the specifics of the plan when the employee signed up for it.) These payments do not exclude the family from seeking a wrongful death lawsuit against the employer, especially in cases where the accident that lead to the employee’s death was considered preventable or was caused by unsafe working conditions that should have been corrected before the accident occurred.
