When employers request to self insure, it is the responsibility of the Commission to approve or disapprove of the application. Finally, the Commission has the responsibility for gathering, maintaining and disseminating statistical information to all stakeholders. The goal of providing equitable and prompt protection financially to workers while keeping premiums and overall cost to employers at a minimum is the primary duty of the Commission.
The Illinois Workers' Compensation Act mandates each employer must have a posted notice in the workplace describing workers rights and providing the contact information for the workers' compensation insurance carrier. In addition, each employer has the responsibility to provide adequate medical assistance when an employee has an on the job injury or illness. Medical treatment includes first response or emergency services. The employee must have at least two choices for physicians, surgeons and hospital stays. The employer is also responsible to provide services to other medical care providers as determined by the hospitals, surgeons, or physicians.
The aim of workers compensation programs in Illinois as well as in other states is to assist in the prompt and reasonable recovery and return to work. To this end, the employer may be required to pay for vocational rehabilitation, mental treatment programs as well as physical treatment. The employee has the responsibility to cooperate in any reasonable program for treatment to aid in recovery.
The role of the Illinois Division of Insurance is to assist in any situation where there is a balance billed by the workers compensation insurance company. Sometimes, workers compensation carriers pay less the the full amount of the charges billed by the service providers. The Division of Insurance acts only when the insurer is a private insurance company--not in cases where the employer is self insured.
The Division of Insurance can become involved in an employer/ insurance company dispute. This usually arises when there is an increase in the amount of premiums. Employers can file a complaint that leads to a compliance investigation of the insurance company. The Division also acts to ensure that the insurance company complies with the ruling on a workers compensation claim.
Both the Division of Insurance and the Illinois Workers Compensation Commission are dedicated to working with employers, insurance companies, service providers and employees to reduce costs while providing reasonable protection to each stakeholder.
