In Louisiana, the employer can select a health care provider and the employee is responsible for using the employer provider for the first ten days of treatment. After ten days, the employee may elect to change the health care provider but must notify the employer of the intention to change and must also notify the employer of who the new health care practitioner is.
Once the employer has been notified by the employee that there has been a work injury, the employer is required to complete a First Report of Injury and provide a copy to the injured worker. The employer must either pay the claim within fourteen days or send a Notice of Controversy indicating that the claim is being disputed to both the injured worker and to the Workers Compensation Board. The next step is by the Workers Compensation Board who will assign a Troubleshooter to the dispute who will contact both the employer and the worker and attempt to resolve the disputed areas. The next step, if the Troubleshooter is unable to solve the cross purposes is to go to mediation between the parties.
If mediation is not successful, the injured worker in Maine can request a formal hearing. Injured workers are able to make use of the services of a Worker Advocate in order to be of assistance to the worker in preparing both for mediation and if necessary, the formal hearing process.
There are several offices located throughout the State of Maine so that assistance can be obtained from the Workers Compensation Board both for employees and employers. Another active component of the Workers Compensation Board in Maine is the Abuse Unit that enforces stipulations under the law such as timely payment of benefits, obtaining workers compensation coverage by employers and appropriate handling of claims at every stage of the process.
